Terms of Service

1. Acceptance of Terms

By creating an account or using the Molted Email API, you agree to these Terms of Service and our Privacy Policy. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Service Description

Molted Email provides an email sending API with policy enforcement, deliverability monitoring, and optional AI-powered email processing. The service is designed for programmatic email sending by software applications and AI agents.

3. Account Responsibilities

• You must provide accurate account information
• You are responsible for safeguarding your API keys and credentials
• You are responsible for all activity under your account, including email sent by AI agents using your API keys
• You must notify us immediately of any unauthorized use

4. Acceptable Use

You agree not to use Molted Email to:

• Send unsolicited bulk email (spam)
• Send email to purchased, rented, or harvested address lists
• Send content that is illegal, harassing, or fraudulent
• Impersonate another person or entity
• Attempt to bypass sending policies, rate limits, or suppression lists
• Use the service to facilitate phishing or social engineering attacks
• Interfere with the service or compromise its infrastructure

We reserve the right to suspend or terminate accounts that violate these policies.

5. AI Agent Usage

If AI agents send email through your account, you remain fully responsible for all messages sent. You must ensure your agents comply with these terms, applicable anti-spam laws (CAN-SPAM, GDPR, CASL), and our sending policies. Our built-in policy engine enforces guardrails, but it does not relieve you of compliance obligations.

6. Sending Policies

Email sent through Molted Email is subject to automated policy enforcement including rate limits, suppression list checks, and content guidelines. Policy violations may result in temporary send blocks or account suspension. See our Rate Limits documentation for details.

7. Billing and Payment

Paid plans are billed monthly. You are responsible for all charges incurred under your account. We may change pricing with 30 days' notice. If payment fails, we may downgrade or suspend your account after a grace period.

8. Data and Privacy

Our use of your data is governed by our Privacy Policy. You retain ownership of the content you send through the service. You grant us a limited license to process that content solely for the purpose of providing the service.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We are not liable for delays or failures caused by circumstances beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law, Molted Email's total liability for any claims arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

11. Termination

You may close your account at any time. We may suspend or terminate your account for violations of these terms or for any reason with reasonable notice. Upon termination, your right to use the service ceases and we may delete your data after a retention period.

12. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or a notice on the service. Continued use after changes constitutes acceptance.
