Terms of Service

1. Acceptance of Terms
By creating an account, accessing the dashboard, or making API calls to Molted Mail, operated by Junghard Software AB ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you are acting on behalf of an organization, you represent that you have authority to bind that organization to these terms. If you do not agree, do not use the Service.
2. Service Description
Molted Mail provides managed mailboxes for AI agents. Each agent gets a dedicated email identity with policy enforcement, multi-provider delivery (Resend, Postmark, Amazon SES), inbound intelligence, outcome attribution, and journey orchestration. The Service is accessed via REST API (Bearer token authentication) and a web dashboard (cookie-based sessions).
Features, integrations, and supported providers may change over time. We will give reasonable notice before removing functionality that materially affects your use of the Service.
3. Account Registration and Security
To use the Service you must create an account with a valid email address and password. When you sign up, we automatically provision a tenant, default mailbox, and default transactional template for your account.
- You must provide accurate, current account information.
- You are responsible for safeguarding your password, API keys, and Bearer tokens. Treat them like secrets — do not commit them to source control, share them in logs, or expose them in client-side code.
- You are responsible for all activity under your account, including every email sent by AI agents using your credentials.
- You must notify us immediately at hello@molted.email if you suspect unauthorized access to your account or API keys.
4. Acceptable Use
Molted Mail exists to help AI agents send legitimate, policy-compliant email. You agree not to use the Service to:
- Send spam. No unsolicited bulk email. No purchased, rented, scraped, or harvested recipient lists. Every recipient must have a legitimate basis for receiving your email.
- Abuse sending infrastructure. Do not attempt to bypass, circumvent, or disable sending policies, rate limits, cooldown periods, suppression lists, deduplication rules, or risk budgets enforced by our policy engine.
- Send harmful content. No phishing, social engineering, malware distribution, fraud, or content designed to deceive recipients about the sender's identity or intent.
- Impersonate. Do not misrepresent your identity or your agent's identity in email headers, from addresses, or message content.
- Send illegal content. No content that violates applicable law, including but not limited to CAN-SPAM, GDPR, CASL, and other anti-spam and data protection regulations.
- Attack the Service. Do not probe, scan, or test vulnerabilities, overload infrastructure, reverse-engineer internal systems, or interfere with other customers' use of the Service.
- Resell without authorization. Do not resell or redistribute the Service as your own email platform without a written agreement from us.
Violations may result in immediate suspension or termination of your account without prior notice. We report illegal activity to relevant authorities.
5. AI Agent Responsibility
Molted Mail is purpose-built for AI agents to send and receive email. This creates specific responsibilities:
- You are liable for your agents. Every email an AI agent sends through your account is your responsibility — regardless of whether the agent acted autonomously, was prompted by a user, or behaved unexpectedly.
- Policy engine is a guardrail, not a guarantee. Our policy engine enforces rate limits, suppression lists, deduplication, cooldown periods, consent checks, and risk budgets automatically. But these guardrails do not replace your obligation to ensure your agents comply with applicable law and these terms.
- Monitor your agents. You should implement appropriate oversight of your AI agents' sending behavior. If an agent malfunctions and sends non-compliant email, your account may be suspended.
- Inbound intelligence is advisory. Features like prompt injection scanning and intent classification are provided to help your agents process inbound email safely, but they are not infallible. You remain responsible for how your agents act on inbound messages.
6. Billing, Subscriptions, and Overages
Plans
The Service is offered in tiers: Trial (free), Starter ($9.99/month), Growth ($39.99/month), and Enterprise (custom pricing). Paid plans include a 14-day free trial and require a valid credit card on file.
Billing cycle
Paid plans are billed monthly in advance. All fees are non-refundable except where required by law. You may cancel at any time — your access continues through the end of the current billing period.
Overages
Paid plans may exceed their monthly email limit up to 2x the plan allowance. Overage emails are billed at the rate specified in your plan details. Once you reach 2x your limit, additional sends are rejected until the next billing cycle. Trial accounts have a hard cap of 100 emails per month with no overage allowance.
Failed payments
If payment fails, we will retry and notify you. After a reasonable grace period (typically 7 days), we may downgrade your account to Trial or suspend sending until payment is resolved.
Price changes
We may adjust pricing with at least 30 days' written notice. Price changes take effect at the start of your next billing cycle after the notice period. If you disagree with a price change, cancel before it takes effect.
7. Usage Limits and Sending Policies
All email sent through Molted Mail is subject to automated policy enforcement:
- Rate limits — per-minute and per-hour send rate caps based on your plan tier.
- Monthly volume limits — Trial: 100 emails/month. Starter: 3,000/month. Growth: 10,000/month. Enterprise: custom.
- Deduplication — identical messages to the same recipient within a configured window are automatically suppressed.
- Cooldown periods — enforced minimum intervals between messages to the same recipient.
- Suppression lists — bounced addresses, unsubscribed recipients, and spam complaints are automatically suppressed.
- Risk budgets — adaptive limits that tighten when deliverability signals degrade.
When a send is rejected by the policy engine, the API returns a clear error code explaining which policy was triggered. Policy-rejected sends do not count toward your monthly volume.
8. API Usage
Access to the Molted Mail API is provided under the following terms:
- API access requires Bearer token authentication. Dashboard access uses cookie-based sessions. Do not mix authentication methods.
- You must handle API errors gracefully. Implement exponential backoff for rate limit responses (HTTP 429). Do not retry indefinitely.
- We may impose or adjust rate limits on API endpoints at any time to protect service stability. Current limits are documented in our API reference.
- Do not use the API in a way that degrades the Service for other customers. Excessive polling, unnecessary retries, or intentionally high-volume requests outside normal sending patterns may result in throttling or suspension.
- API versioning: we will maintain backward compatibility within a major API version. Breaking changes ship under a new version prefix with a deprecation notice on the old version.
9. Data Ownership and Processing
Your data is yours. You retain full ownership of all content you send through the Service, all recipient data you provide, and all configuration you create (templates, journeys, mailbox settings).
You grant us a limited, non-exclusive license to process your data solely to provide and improve the Service — including delivering email, enforcing policies, generating analytics, and running inbound intelligence features. We do not sell your data or use it to train machine learning models outside the scope of your account.
Upon account termination, you may request export of your data within 30 days. After this period, we delete your data from active systems in accordance with our Privacy Policy. Backups may retain data for up to 90 days after deletion from active systems.
10. Intellectual Property
The Service — including its software, API, documentation, design, and branding — is owned by Molted Mail and protected by intellectual property laws. These terms do not grant you any rights to our trademarks, logos, or brand assets.
We do not claim ownership of your content. You do not claim ownership of ours. Each party retains their respective intellectual property rights.
11. Service Availability
We target high availability and use multi-provider delivery with automatic failover to maximize uptime. However, we do not guarantee uninterrupted or error-free service. Specifically:
- Scheduled maintenance windows will be announced at least 24 hours in advance when possible.
- We are not liable for delivery failures caused by third-party providers, recipient mail servers, DNS misconfigurations on your domain, or other factors outside our control.
- Enterprise plans may include SLA commitments with defined uptime guarantees and remedies. These are specified in your Enterprise agreement and supersede this section.
- For non-Enterprise plans, we will make commercially reasonable efforts to maintain service availability but do not offer guaranteed SLAs or service credits.
12. Termination and Suspension
By you
You may close your account at any time from the dashboard. Closing your account cancels your subscription at the end of the current billing period. No prorated refunds are issued for the remaining days in the period.
By us
We may suspend your account immediately and without notice if we reasonably believe you have violated the Acceptable Use or AI Agent Responsibility sections of these terms. For other violations, we will give you reasonable notice (typically 7 days) and an opportunity to cure before suspension.
We may terminate your account for: repeated violations after warnings, non-payment after the grace period, legal requirements, or if we discontinue the Service entirely (with at least 90 days' notice in that case).
Effect of termination
Upon termination, your API keys are revoked, sending stops immediately, and dashboard access is disabled. You have 30 days to request a data export. After 30 days, we delete your data per our retention policy. Sections that should survive termination (liability, IP, governing law) survive.
13. Limitation of Liability
To the maximum extent permitted by applicable law:
- Cap. Junghard Software AB's total aggregate liability for any and all claims arising from your use of the Service is limited to the amounts you paid us in the 12 months immediately preceding the event giving rise to the claim, or $100, whichever is greater.
- Exclusions. We are not liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, business interruption, or reputational harm — regardless of the theory of liability.
- No guarantee of delivery. Email delivery depends on factors beyond our control (recipient servers, spam filters, DNS configuration). We do not guarantee that any specific email will be delivered to a recipient's inbox.
The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Indemnification
You agree to indemnify and hold harmless Junghard Software AB ("Molted Mail"), its officers, employees, and agents from any claims, losses, or damages (including reasonable legal fees) arising from: (a) your use of the Service, (b) email sent through your account (including by AI agents), (c) your violation of these terms, or (d) your violation of any applicable law or regulation.
15. Changes to Terms
We may update these terms from time to time. When we make material changes, we will notify you via email to your account address and post a notice on the Service at least 14 days before the changes take effect. Non-material changes (typo fixes, formatting) may be made without notice.
Your continued use of the Service after the effective date of updated terms constitutes acceptance. If you disagree with the changes, stop using the Service and close your account before the effective date.
16. Governing Law and Disputes
These terms are governed by the laws of Sweden. Any disputes arising from these terms or your use of the Service will be resolved by Göteborgs tingsrätt (Gothenburg District Court), Sweden.
Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at hello@molted.email. We will attempt to resolve the dispute within 30 days.
17. General Provisions
- Entire agreement. These terms, together with our Privacy Policy and any Enterprise agreement, constitute the entire agreement between you and Junghard Software AB.
- Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
